Release of Liability:

In consideration of the services and arrangements provided by Caribbean Destination Travels, Inc. and the Tour Operator, you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify Caribbean Destination Travels, Inc. sales agent and the Tour Operator, and its owners, officers, directors, agents, contractors, subcontractors and employees from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during my travel in connection with the scheduled Trip and any activities conducted in conjunction therewith. Caribbean Destination Travels, Inc. acts as agent for services provided by operators herein and cannot be held liable for any services provided listed in this brochure/Website or any other services incidental thereto. Further the responsibilities of air carriers are limited in accordance with international agreements and tariffs. Whereas Caribbean Destination Travels, Inc. and the participating airlines and tour operators operate the land tours offered under this program only as agents of the aircraft, railroads, car rental contractors, steamship lines, hotels, bus operators, sightseeing contractors and others who provide the actual land arrangements. The Passenger contract in use by the airline concerned shall constitute the sole contract between the airline and the purchaser of these tours and/or passenger. Caribbean Destination Travels, Inc. reserves the right to bring legal action to collect damages in the event that purchaser fails to pay any fees due and owing for services, including cancellation fees as set out in the section entitled ’Cancellations & Refunds’. The parties agree that should legal action be commenced, the prevailing party will be entitled to his/her or its reasonable attorney fees and court costs in addition to the actual damages sustained and proven. Venue for any dispute is Miami Dade County Circuit Court, Florida. This contract shall be governed by the laws of the State of Florida. YOU SPECIFICALLY UNDERSTAND THAT YOU ARE RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT YOU MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR CONDUCT OF THE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SUBCONTRACTORS OF CARIBBEAN DESTINATION TRAVELS INC. AND THE TOUR OPERATOR.

Voluntary Participation and Assumption of Risk:

I voluntarily apply to participate on a trip under the arrangements of Caribbean Destination Travels, Inc. (hereafter referred to as CDTravels) Customer’s must accept these attendant risks and hazards. Customer must also accept that safety standards of hoteliers and other suppliers of accommodation, local transport and other operators in most of the countries visited during the Trip may not be of the same standard as in Customers home country. Due to political and cultural differences, as well as generally tougher physical conditions, travel to many areas of the world involve risks other than those we take in our daily lives. with knowledge that travel to foreign countries and /or remote areas visited by this trip involves numerous risks including, but not limited to: accommodations, roads, trails, vehicles, boats, aircraft, or other means of conveyance which are not maintained or operated to standards common in the United States of America;  forces of nature; accident or illness . I understand that CDTravels will have no liability regarding the adequacy of any evacuation plan, medical care, equipment or supplies that may be provided. I agree to be responsible for my own and accept any and all risks of delay, unanticipated events, illness, injury, emotional trauma and death.

Passenger responsibility:

Passenger has read the above terms and conditions and agrees to each of them. Passenger hereby warrants that they fully understand each of them. Specifically passenger understands that should he/she cancel their trip for any reason, passenger will be charged the cancellation fee set out in the ’Cancellations & Refunds’ section.

Land Arrangements:

The Tour Operator reserves the right to change the itinerary due to unforeseen circumstances. In all cases, Caribbean Destination Travels, Inc. will do its best to maintain the content of the tour. The Tour operator reserves the right to change the hotels listed on the tour for others of similar quality.

Travel Documents:

Customers must be in possession of valid passports and any visas, permits and certificates required for the whole of their Trip and shall arrange such vaccinations as are normally recommended for the countries through which they intend to travel including those vaccinations recommended by the Tour Operator. Information as to these matters and as to climate, clothing, baggage, gear, and similar matters is given in good faith but without responsibility on the part of Caribbean Destination Travels, Inc.

Rates and Fares:

  • The prices of the tours are guaranteed, but if unforeseen circumstances beyond Caribbean Destination Travels, Inc. control occur, i.e. increased government taxes, etc., CDTravels will adjust the price accordingly.
  • Prices are subject to change due to fluctuation in currency exchange rate.

Deposit and Payment Policy:

  • A $500 deposit per person, is required upon booking the tour.
  • Final payment is due 60 days prior departure.
  • If booking within 21 days of travel, full payment is required upon booking per person will apply.
  • A change fee of $50 per person will apply to any changes made by the traveler after confirmation has been sent.

Booking Procedure:

Caribbean Destination Travels, Inc. booking is not accepted and no contract exists until the Sales agent has received a properly completed booking form, either electronically or in handwritten form along with the appropriate deposit and has confirmed your booking in writing. This will occur upon completion of payment from the Customer. Either Caribbean Destination Travels, Inc. sales agent or the Tour Operator may in its discretion refuse any booking and may at any stage cancel an accepted booking without giving any reason therefore.

Cancellations and Refunds:

  • Transportation, lodging, meals, entertainment and other services are sold on a partial refundable basis depending upon the date, in relation to the departure date, such services are cancelled. The cancellation fees and calculations are set forth below.
  • 61 days or more prior to departure, a service fee of $100 per person will apply.
  • If a tour is canceled within 60 days of departure date and full payment was not received in our office, the deposit will then be forfeited in full.
  • Once full payment has been received, any refund made will be subject to a $100 per person administrative fee.
  • 45 to 30 days prior to departure, a cancellation fee of 50% of the tour cost will apply.
  • 29 to 15 days prior to departure, a cancellation fee of 75% of the tour cost will apply.
  • 14 days or less prior to departure, a cancellation fee of 100% of the tour cost will apply.
  • No refund will apply to any unused services including but not limited to flights, accommodations, touring, meals and/or transportation.

Entire Agreement Severability:

This is the entire agreement of the parties and it may be amended only by written agreement signed by both Caribbean Destination Travels, Inc. and the client. If any part of this agreement is held unenforceable by a court of law, the rest of this agreement will nevertheless remain in force and effect.

Knowing and voluntary execution: My signature below certifies that I have carefully read and fully understand the contents of this agreement including the terms and conditions, especially those regarding cancellation and refund policies, limitation of liability, and responsibility borne by trip participants. On the advance of a deposit to CDTravels, the depositor, his or her family agrees to be bound by the above terms and conditions.

In the event that an arbitrator or court of law declares any term or terms of these documents invalid, such declaration shall not affect the remainder of the terms of the agreement which shall be valid and enforceable.

If I am signing on behalf of a minor, I agree to release, hold harmless and indemnify CDTravels for any claims of the minor. (If applicant is under 18 years of age, a parent or legal guardian must sign for the minor).

I understand this is a legally binding and enforceable contract and sign it of my own free will.
